Islamic Forex Trading Agreement

1. Acceptance of Terms

By accessing or using AutoNom Trading's Sharia-compliant EA/AI trading services, you agree to be bound by these Terms & Conditions. If you disagree with any part, please do not use our services.

2. Eligibility & Islamic Compliance

You must meet the following requirements:

  • Be at least 18 years old (21 in some jurisdictions)
  • Have the legal capacity to enter into binding agreements
  • Have a minimum of $10,000 USD in your trading account
  • Use a genuine swap-free/Islamic account with a supported broker
  • Complete our KYC/AML verification process
  • Acknowledge and accept the risks of forex trading

  • Seek to trade in accordance with Islamic finance principles
  • Understand that swap-free accounts may have administrative fees
  • Accept responsibility for consulting your local Islamic scholar
  • Will not hold us liable for differing scholarly opinions

3. Fees & Payment (Sharia-Compliant)

Our fees are transparent, fixed, and non-interest based:

  • One-time setup fee: $300 (due upon registration) - Covers account configuration, Sharia verification, and onboarding
  • Monthly management fee: $35 (billed monthly in advance) - Covers ongoing AI trading, optimization, and Sharia monitoring
  • No performance fees or profit sharing (avoiding gharar/uncertainty)
  • No interest-based charges (riba-free)
  • Fees are subject to change with 30 days' notice

4. Swap-Free Account Requirements

You must maintain a genuine Islamic/swap-free account:

  • No interest (riba) on overnight positions
  • Transparent administrative fees only (if any)
  • We reserve the right to verify your swap-free status with your broker
  • Using a standard account with our EA violates these terms
  • We recommend AvaTrade Kenya for verified swap-free accounts

5. Risk Acknowledgment

You acknowledge that forex trading involves substantial risk, even with Sharia-compliant accounts:

  • You may lose all or more than your initial investment
  • Past performance does not guarantee future results
  • We do not guarantee profits or capital preservation
  • You should only trade with risk capital you can afford to lose

6. Termination

Either party may terminate this agreement with 7 days' written notice. Upon termination:

  • Our EA/AI will be disconnected from your account within 24 hours
  • Any prepaid monthly fees will be refunded on a pro-rata basis
  • Setup fee is non-refundable after 14 days
  • Your trading data will be retained as required by law

7. Limitation of Liability

To the maximum extent permitted by law, AutoNom Trading shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Trading losses incurred through our EA/AI system
  • Technical failures, connectivity issues, or broker problems
  • Losses resulting from market volatility or force majeure events

8. Sharia Compliance Guarantee

We guarantee our best efforts to maintain Sharia compliance:

  • Our EA/AI is programmed to avoid interest-bearing transactions
  • We work exclusively with brokers offering swap-free accounts
  • Our Sharia Supervisory Board reviews our operations quarterly
  • We provide a Sharia compliance certificate annually
  • Individual scholars may have differing opinions - consult your local scholar

9. Governing Law

These terms shall be governed by the laws of Kenya. Any disputes shall be resolved through binding arbitration in Mombasa, Kenya, in accordance with Islamic dispute resolution principles where applicable.
